ASB Case Review
The anti-social behaviour case review gives victims and communities the chance to address antisocial behaviour that they have reported but feel has not been reviewed properly.
This could be any incident that has been reported to the police, council or registered social landlord.
You can apply on behalf of someone else if you have their written consent.
You can use this process if:
- you have reported three anti-social behaviour or hate incidents about the same issue in the last six months to the police, the council or your housing provider and no action has been taken
- the antisocial behaviour or hate incident was reported within one month of the incident taking place
You must make the application within six months.
Please note the case review does not replace the complaints procedure.
We will let you know within three working days whether your case will be reviewed. If yes, a further review will then be carried out and recommendations will be given on how to progress your case. This will be reported to you within a further ten days.
If you are not happy with the decisions made or wish to comment on the service received, you can use the complaints procedure for the agency dealing with your case.
Case Review Activations
The Anti-Social Behaviour, Crime and Policing Act 2014 created a statutory duty for relevant bodies to undertake anti-social behaviour case reviews in circumstances where a threshold has been met.
This allows victims and communities to hold agencies to account if they believe that their complaints relating to anti-social behaviour have not been dealt with appropriately.
The law requires that the relevant bodies publish information detailing:
• the number of applications for the ASB case reviews received
• the number of times that the threshold for review was not met
• the number of anti-social behaviour case reviews carried out
• the number of anti-social behaviour case reviews carried out that resulted in recommendations being made
