Judicial Review update - Kingston
Permission to apply for Judicial Review of the council's decision to grant planning permission for 47 dwellings at Kingston Lane, East Preston (K/46/23/PL) was sought in November 2024. The council was notified yesterday that the permission has been refused by the court as the application was considered to be totally without merit. The court concluded that the application had no legitimate basis for the claim to succeed and that the council's decision was correct. The applicant can apply for permission to appeal this judgement at the Court of Appeal if they believe that the conclusions are not correct.
